Parental Consent
As a parent, you have the right to be informed whenever the school decides to:
1. Conduct an evaluation to see if your child is eligible for special education services
2. Initially provide services of special education or related service to your child
3. Re-evaluate your child.
This notification must be presented in your native language. The district must obtain your informed consent by using state-mandated forms.
Other consents that are not in the mandated forms include the following:
1. Access insurance benefits
2. Use of an IFSP (Individualized Family Service Plan) instead of IEP (Individualized Educational Plan)
3. Release your child’s records
Schools may only require consent for the intended service that pertains to your family.
If your child does not reside with you, the district is exempt from obtaining consent if the district makes valid efforts to contact you and despite those efforts:
1. Your whereabouts are unknown
2. Your rights have been terminated in accordance with Illinois law
3. Your rights to make educational decisions have been terminated due to a judge and in accordance with Illinois law and consent has been granted to another appointed individual
If the school is reviewing previous data or administering tests that are given to all students within the school, they do not need to obtain your consent.
