Mediation
- Means of resolving disagreements regarding the appropriateness of special education/related services to children.
- Must be voluntary participation by you and school district and is no cost to either party.
- Mediator is a third party individual who is trained in mediation, laws, and regulation of special education and related services.
- About 3 persons/party for mediation process; including an attorney, advocate, interpreter, or other related individuals.
- Mediation will ask you to: consider alternatives which could be included in the child's program, listen to concerns expressed by both parties, and be realistic about the child's capabilities and the district's obligations and resources.
- If a resolution has been found during mediation process, a written agreement will be signed by you and school district representative that is legally binding and enforceable in any court.
- Mediation efforts cannot be used as evidence in any court or civil proceeding and mediator cannot be called as a witness in court.
