- You may ask hearing officer for clarification of final decision in writing within 5 days after decision has been made.
- Hearing officer must provide or deny clarification within 10 days of request.
Appealing the Decision:
- Within 120 days after a copy of the decision has been mailed, any party dissatisfied with final order has the right to appeal the decision to any State court or United States District Court.
Stay of Placement:
- Your child must remain in his/her present educational placement during the due process hearing proceeding.
- During expedited hearing disciplinary removal situation, child can be placed in district's new placement until after hearing decision has been made.
