Complaint Resolution
- Concerns about identification, evaluation, or educational placement of a student should be directed to local school district.
- Concerns about the rights of a child with a disability being violated should be addressed to the Illinois State Board of Education in a formal complaint (within 1 year of occurrence).
- Formal violations must include: statement of violation and facts to support the claim, name/address of involved student, student's current school placement, your signature and contact information, and a proposed resolution to problem.
- After the Illinois State Board of Education receives the complaint, they will: give you an opportunity to submit additional information, provide the district with an opportunity to solve/mediate the problem with the you, review all submitted information to determine if the district violated a special education requirement, and provide a written decision regarding the violation allegation with reasons for why decision was made.
- All of these actions will occur in a 60-day period unless district-parent mediation process is occurring.
