Your Rights During Hearing:
The Hearing:
Expedited Hearings:
- To Have a fair, impartial, and orderly hearing.
- To have the opportunity to present evidence, testimony, or arguments.
- To close the hearing to the public.
- To have your child present at hearing.
- To confront and cross-examine witnesses.
- To prohibit the introduction of evidence not disclosed at least 5 days prior to hearing.
The Hearing:
- Must take place within 45 days after the receipt of the request for a hearing.
- Officer must provide a written decision within ten days of the conclusion of the hearing which displays issues in dispute.
- Officer must make a determination about all issues raised in the hearing.
Expedited Hearings:
- May be requested when you disagree with district's decision to remove child from current educational placement due to disciplinary issues.
- Resolution session must occur within 7 calendar days of filing request.
- Hearing must take place within 20 school days of request.
- Decision must be provided within 10 days of conclusion of hearing.
- No hearing officer substitutions allowed.
