Educational Surrogate Parents
- District must make reasonable attempts to contact parents of child in need of services
- If they cannot be identified or located or if the child is a ward of the state in a residential facility, an educational surrogate parent is provided
- If ward of the state, judge may appoint parent
- If homeless, district will appoint parent
- If in foster care or a relative caretaker, there is no need for a surrogate parent
- Surrogate may not be employee of public agency involved in education or care of child
- Surrogate may not have conflict of interest with child
- Surrogate must have the knowledge necessary to represent the child
- Surrogate can represent child in identification, evaluation, placement, and provision of a free, appropriate public education
