When FAPE is an Issue
If you enrolled your child in a private school because you believed that FAPE was not being adhered to within the school then you are entitled to:
-Reimbursement of private education determined by court or hearing officer due to lack of FAPE provided within a timely manner of enrollment
Reimbursement may be reduced if:
-You did not inform the IEP team of failure to provide services and intent to place child in nonpublic education
-You did not inform the district within 10 days of the information from above
-Prior to the removal of your child, the school intended to evaluate but you did not make your child available for evaluation
-The judge finds your actions unreasonable
The above mentioned does not apply if
-A parent/guardian cannot read or write in English
-Compliance with notice requirements would cause physical or emotional harm to your child
-The school prevented you from provided notice
-You were not made aware of the notice requirements
