Absence of Consent
If you refuse consent for any of the below listed items, the following things may occur:
1. Initial Evaluation
-The district may pursue having an initial evaluation performed under mediation or due process hearing procedures (Link here)
-If due process is held, the district may receive consent for conducting the initial evaluation
-You may appeal that decision and have your child remain in his or her current educational placement pending any further
2. Initial Services/Placement
-The district will not provide these services
-The district will not pursue mediation or due process
-The district is not required to provide a free and appropriate education (FAPE)
-The district will not convene to make an IEP for your child
3. Reevaluation
-The district may pursue mediation or due process to reevaluate your child
-If you fail to respond and the district has made many attempts to contact you, the
district may conduct the reevaluation
-If the district chooses not reevaluate, they are not in violation of FAPE
